'Unthinkable and devastating': Romney slams Obama on defense cuts

(Alex Wong/Getty Images)SPRINGFIELD, Va.?For the third straight day, Mitt Romney and President Barack Obama campaigned in the same state, with Romney arguing before an audience of military veterans that potential cuts to the defense budget are "unthinkable and devastating."

Speaking in the battleground state at an American Legion post outside Washington, D.C., Romney blamed Obama for planned defense cuts agreed to under a 2011 vote to raise the debt ceiling, known as sequestration, calling it a "kind of a gun-to-your-head opportunity" that will kill jobs in Virginia.

"They would make devastating cuts to our military. It's a strange proposal in the first place, even stranger that it's being put in place," Romney said. "The impact will be immediate, and significant right here in Virginia: 136,000 jobs will be lost in Virginia as a result of this move."

The White House has pointed out that Rep. Paul Ryan, Romney's running mate, and other Republican congressional leaders supported sequestration when it was proposed. Romney has previously said it was a "mistake" for Republicans in Congress to back the deal.

But speaking in Virginia, Romney put the blame squarely on Obama?arguing the president is cutting the military at a time of turmoil around the world.

"It is still a troubled and dangerous world. And the idea of cutting our military commitment by a trillion dollars over this decade is unthinkable and devastating," Romney declared. "And when I become president of the United States, we will stop it. I will not cut our commitment to the military."

Romney spoke at approximately the same time Obama held his own campaign event in Virginia Beach. A recent Fox News poll found Obama leading Romney by 7 points among likely Virginia voters, 50 to 43 percent.

Trademark: Christian Louboutin S.A. v. Yves Saint Laurent Am. Holdings, Inc. (2nd Cir. 2012)

The Court of Appeals for the Second Circuit recently ruled in Christian Louboutin S.A. v. Yves Saint Laurent Am. Holdings, Inc. that there exists no per se rule preventing a single color from serving as a trademark in the fashion industry. Rather, like in other industries, consistent use of a color by a fashion designer may result in a trademark. And such a trademark may be successfully enforced if, among other things, enforcement does not run afoul of the so-called aesthetic functionality doctrine that was recognized and validated by the United States Supreme Court in Qualitex Co. v. Jacobson Products Co., 514 U.S. 159 (1995).

The Louboutin fashion house of France brought suit against Yves Saint Laurent, another French fashion company, seeking injunction of the latter?s distribution of women?s high fashion shoes with red lacquer outsoles. Louboutin has, since 1992, distributed its signature footwear that features a bright, lacquered red outsole, which nearly always contrasts strikingly with the color of the rest of the shoe. In the words of the Court, this red outsole has become closely associated with Louboutin in the high-stakes commercial markets and social circles in which these things matter a great deal.

In the District Court, Louboutin requested preliminary injunction of YSL?s distribution of shoes with a red lacquer outsole (whether or not the color of the outsole contrasted with the color of the rest of the shoe). The District Court denied that request stating that issuance of injunction would violate a per se rule that a single color can never be protected by trademark in the fashion industry. According to the District Court, in the fashion industry, single-color marks are inherently functional and, as such, any such mark is likely to be held invalid. According to the District Court, ?there is something unique about the fashion world that militates against extending trademark protection to a single color.?

Upon review, the Circuit Court found that reference by the District Court to a per se rule was error. The Circuit Court noted that Qualitex expressly held that ?sometimes[ ] a color will meet ordinary legal trademark requirements[,a]nd, when it does so, no special legal rule prevents color alone from serving as a trademark.? Qualitex forbids application of a per se rule.?

Rather than refuse injunction on the basis of a per se rule, the Circuit Court held that the District Court should have come to a particularized conclusion as to whether, or not, the Louboutin mark is functional and, thus, unenforceable. Courts in the United States have long held that certain trademarks that act not only as a source indicator but also ?satisfy a demand for the aesthetic? are sometimes vulnerable to an affirmative defense of aesthetic functionality. According to the Circuit Court, a mark is aesthetically functional, and therefore unenforceable against a competitor, only where protection of the mark significantly undermines competitors? ability to compete in the relevant market. In making the determination, courts must carefully weigh the competitive benefits of protecting the source-identifying aspects of a mark against the competitive costs of precluding competitors from using the trademark feature. The courts must inquire as to whether recognizing the trademark would put competitors at a significant non-reputation-related disadvantage.?

The Circuit Court did not itself apply an aesthetic functionality analysis to the mark at issue in the case. It used other grounds to refuse to enforce Louboutin?s claimed trademark against YSL. Specifically, the Court instructed the Director of the Patent and Trademark Office to limit the registration of Louboutin?s mark to only those situations in which the red lacquered outsole contrasts in color with the adjoining ?upper? of the sole. Since the accused YSL shoes are monochromatic (i.e., the outsoles are of the same color as the uppers), the trademark (as modified) is not infringed.

There are at least three points to make about this case.

1. Narrowness of Trademark. This Circuit Court opinion modifies the Louboutin trademark to include only those situations in which the ?red lacquered outsole contrasts in color with the adjoining ?upper? of the shoe.? Monochromatic shoes do not even arguably infringe the mark. Further, there is not even an argument to be made by Louboutin that it can prevent another shoemaker from distributing shoes with outsoles of a color other than red. For example, white or yellow outsoles. Query whether the Circuit Court should have taken another limiting step by narrowing Louboutin?s trademark to outsoles of a particular shade of red. The Court could have, for example, narrowed the trademarked color by reference to a Pantone number.?

2. No Application of Defense by Court. Very importantly, as noted above, the Circuit Court in this case did not actually apply the aesthetic functionality test that it took pains to outline. Thus, even after this opinion, Louboutin may be unable to succeed in an action enforcing its trademark. A future defendant may very well be able to defend against an infringement claim by convincing a District Court or jury that Louboutin?s trademark is in fact aesthetically functional under the test outlined by the Second Circuit. This case merely disallows the per se rule referenced by the District Court. It does not eliminate the defense of aesthetic functionality. The lower courts in the Second Circuit remain entitled to refuse to enforce single-color marks in the fashion industry upon a particularized finding of functionality. Which, in the end, may happen with regularity. The per se rule merely becomes a de facto rule.

3. Market Analysis. Under the case law, determining whether a mark is aesthetically functional boils down to the court conducting a market analysis. As noted above, and as ruled in this case, a mark is aesthetically functional, and therefore unenforceable against a competitor, where protection of the mark significantly undermines competitors? ability to compete in the relevant market. Thus, in a hypothetical future case brought by Louboutin, if the trial court defines the relevant market broadly as the market in women?s shoes, it will likely not find the mark functional. This is true because enforcement of the mark would not significantly undermine competition in this otherwise very broad and wide open market for women?s shoes. Alternatively, if the court defines the relevant market narrowly as the market in women?s high fashion shoes with outsoles of a color that contrasts with the color of the shoe upper, then that court should find it impossible for more than a handful of competitors to compete on an equal footing if a trademark or red contrasting outsoles is enforced. This is true because there are only a limited number of primary and secondary colors, (i.e., red, blue, yellow, green, purple, orange, white, and black) from which each competitor may choose for use with its outsoles. Indeed, there are eight such colors. If each competitor were to trademark one of these colors, there would be room for only eight competitors. This numerical limit to primary and secondary colors is one reason why the temptation to declare a per se rule against single-color trademarks in the fashion industry is so great.

Starting a Family Blog : The Village Family Magazine

In 2011,?when Melissa Cook?s son, Jaxon, was 18 months old, and she was pregnant with her daughter, the Bemidji, Minn., mom realized she needed an easy way to update her friends and family?many of whom lived half a world away?on her family?s adventures in Vojens, Denmark.

Cook?s husband, Brendan, is a professional hockey player and played with a team in Denmark last year. This year the family is headed to Germany for the season.

Cook, 31, didn?t want to use Facebook for updates because it seemed impersonal and didn?t paint a picture of their family?s experience. She shied away from Flickr for her photos because her story was more than a photo stream. Her solution: create a blog that allowed her to share her adventures with relatives and friends.

A blog?short for ?Web log??is an online personal journal hosted on a website on which an individual or group of users record opinions, information, etc., on a regular basis. The blog can feature personal information about interests and hobbies.

Cook?s friends and family members love her blog, aptly named ?Another Place Called Home? due to her effort to cultivate a home no matter where her family travels.

?I want my children to know that they?re home wherever we live. As long as the four of us are together, we?re home,? she says.

How to Start a Free Family Blog

Creating a family blog is a fantastic project for the whole family. One advocate of family blogging called it an ?evolving keepsake.?? Blogs are great places to share family milestones, your kids? achievements, fun photos, and artwork. All you need is a computer, an email address, and an Internet connection to get started. If you don?t have a computer at home, a public library is a great place to access one.

STEP 1: Choosing a Platform

Cook chose to use WordPress.com for her blog, which currently has the largest number of users and the greatest variety of themes for displaying blogs. In addition to WordPress, other popular blogging platforms include
Blogger.com, which is owned by Google. Blogger.com is very easy to use but has fewer themes to display words and pictures. For those who?d like to share fewer words, Tumblr.com is a good choice to display pictures and graphic art. All of the platforms have social networking features that allow you to share blog updates.

Photo-sharing websites Shutterfly.com and Flickr.com also contend in the blogging arena. This choice is a great option for family members who have shared a family reunion or holiday together where many pictures are taken. It is an effective way for a variety of contributors to add and view content in one place.

Most platforms have a variety of privacy settings, so consider who you want to have access to your blog when making your selection.

STEP 2: Set Up Your Writers

Though Cook is the only contributor to her blog, many families choose to share login information, which allows multiple members of the family to contribute posts and pictures to the blog and stay connected with family news.

?I like that I can control the amount of information about our lives that everyone sees,? Cook says.

When allowing multiple authors, everyone should be clear on what information is fair game. Maybe your son doesn?t want the world to know the story of how he was sleepwalking and ate from the family dog?s dish. Be sensitive to your child?s needs and get permission from school-age or older kids first as to whether or not they want their art or funny stories posted on the family blog.

STEP 3: Naming Your Blog

Once you and your family have chosen which blogging platform to use, and who is going to author it, it?s time to name your blog. Do some family brainstorming. Get creative. The name will be part of the blog?s Internet address, so be sure to use a memorable name that isn?t too complicated.

STEP 4: Designing Your Blog

Depending on your skill level, and the skill level of the family members contributing to the blog, make the blog as straightforward or sophisticated as you?d like. Most platforms walk users through the process with videos and forums so you can quickly get your design questions answered. You?ll need to choose a color scheme, font type, and layout. Once you get the hang of it, try adding a ?widget??a tool that allows you to display an archive, photo stream, traffic counter, calendar, or countdown to make the blog more interactive with your audience.

STEP 5: Posting

The final step in getting started is to post the first entry to your blog. Cook used her first post as an opportunity to introduce the purpose of the blog, which was to keep friends and family updated on their adventures on the road.

Posts can include text, photos, and even videos. Don?t forget to involve the kids! Try scanning in your children?s drawings and post their art to your blog?show them how others can now view their accomplishments online, potentially all over the world. Remember, nothing should be posted that could embarrass or offend anyone, or jeopardize your career or future aspirations. Think before you post.

Your Family?s Life: Private or Public?

Not every blog needs to be available to the public. Some families choose to password-protect their blog so they have more control over the viewing audience.

You can make your blog interactive by allowing viewers to add comments, or close the comments section if you don?t wish to moderate comments. You?ll have the capability to delete any comments you deem inappropriate or unnecessary even if the comments section is open.

Lindsey Groettum, 31, a special education teacher in Denver, Colo., with ties to family in Minnesota started a blog on
Blogger.com as a way to open up about the struggle she and her husband endured in their quest to start a family.

Groettum searched online for support to find others who wrote about the private, physical, and emotional experience of miscarriage but couldn?t find what she was looking for. That was motivation for her to share her story.

?I posted my first blog entry on the one-year anniversary of trying to conceive,? she says. ?When I originally signed up for the blog, I thought I?d be sharing pictures and stories about traveling with my husband, Andy.?

One of the initial roadblocks to contributing to the blog for Groettum was choosing a theme.

?When I found myself feeling hopeless after two miscarriages, I felt like I didn?t know myself anymore because it was becoming difficult to find the good in anything,? reveals Groettum. ?I found myself using small milestones to measure my day and it helped me stay positive. That?s when it came to me?the little things. ?The Little Things? became the theme and name for my blog.?

The response Groettum received from that first post revealing the couple?s struggle was overwhelming.?Friends and family showed support for the Groettums and what they were experiencing. Groettum heard from women from all different parts of her life that could relate and were thankful for someone who spoke out about the true and honest feelings that go along with the experience of miscarriages.

Since beginning her blog, Groettum feels more confident, less stressed, and calmer. Her husband has even noticed the transformation and sees the blog as a great accomplishment for her, an outlet for her and her feelings and stories. The Groettums are now excitedly expecting their first child in November.

Benefits and Drawbacks of Family Blogging

Rachel Blumhardt, an outpatient mental health counselor in The Village Family Service Center?s Fargo office, agrees with Groettum and believes there are definite benefits to blogging, but also some negative aspects.

?I have often recommended as part of therapy that clients keep a?private journal as a healthy outlet to express feelings and process problems,? shares Blumhardt.??The difference, of course, is that a written journal is typically private and blogging is often a very public experience.?

Blumhardt believes the unfiltered views of others in response to one?s blog may be affirming at times and at other times detrimental.?She feels the overall psychological well-being of the writer doing the blogging is very important in how beneficial the process can be.

?If you are emotionally sensitive and the subject matter is such that certain feedback would upset you, then a private journal might be a more appropriate avenue,? says Blumhardt.

?Blogging is a great way to document our life,? adds Groettum. ?The blog will be a living photo album of sorts for us to look back on and a way to share our life with our children.?

Both Groettum and Cook agree that there is one disadvantage to blogging. And that is, communication sometimes slowed with friends and family once they launched their blogs. ?Sometimes my friends think that what I post on the blog is the only thing that is happening in my life,? shares Groettum. ?I get fewer phone calls and emails because friends and family think they?re keeping up with me by reading the blog.?

Cook agrees.

?What I share on the blog isn?t the complete picture,? she says. ?It?s still important to stay in touch, and my blog doesn?t replace that. Skype is now filling that gap for us when we?re overseas so we can get face time with our family.?

Some treatments affect the hormones that play a role in hair growth, while others treat conditions that can cause hair loss.? Rogaine is the only FDA-approved topical treatment for female hair loss.? Some studies have suggested that it may be effective for some women by prolonging the hair's growth phase; however, it can take up to a year to see any results.? Before exploring the more costly medical treatments it's a good idea to take a look at common reasons for increased hair loss.? Your diet can play a strong role in hair health, and some women who skimp on protein may see a decrease in hair thickness.? Increasing your dietary intake of B vitamins (or adding a supplement) can help with hair health.? Low iron levels may also contribute to hair loss, but consult with your healthcare provider first to determine if you are in need of an iron supplement.?

Stress is another major cause of hair loss that's easily treatable.? Exercise, meditation, breathing techniques and improved sleeping habits can all play a big role in reducing the stress hormones that can increase hair loss.?

Additionally, certain hairstyles can contribute to hair loss, such as wearing tight braids, extensions or using hair bands that can cause breakage.? (AP) ? Entire stadiums have booed them. The Patriots' Bill Belichick grabbed one by the arm and the Redskins' Kyle Shanahan was so hopping mad he followed one into the tunnel after the game.

But it took the team that Vince Lombardi built, playing in a "Monday Night Football" headliner, to put the NFL's latest labor headache ? locked-out officials and their struggling, under-fire replacements ? front and center for the nation. Even President Barack Obama, a Bears fan slogging through a re-election campaign, weighed in Tuesday, saying, "We've got to get our refs back."

Is this where the NFL's lockout of its regular refs comes to an end? On a call that many believe cost the Packers and their Cheesehead-wearing followers a win at Seattle?

The NFL stood fast, giving no sign Tuesday that it was close to reaching a new labor pact with the referees' union. But the outrage grew beyond NFL players (risking fines for speaking out) like Falcons tight end Anthony Gonzalez, who tweeted: "How do you miss that? Pop Warner refs would have gotten that right."

LeBron James tweeted he was "sick" about it and Dirk Nowitzki said he was "not gonna watch another nfl game until real refs" return, while fans pretty much everywhere except Seattle concluded that Green Bay was robbed. Some threatened to boycott until order is restored and others tried to pull the plug on their NFL satellite television packages, only to be told that they can't cancel in the middle of the season.

"I don't really want to give them money if they're going to be greedy about things," said Packers fan Chris Kroening, who lives in Milwaukee. "It's just not that fun to watch any more. I can find better things to do on a Sunday afternoon than watch refs make bad calls."

For all their outrage, Kroening and Michael Mantuano, a Packers fan in Pine Bluff, Ark., both acknowledged that they would probably be watching on Sunday when Green Bay hosts the Saints.

"Yeah, I'm going to watch the game because I still love the Packers," Mantuano said. "But it's a bitter pill to swallow on Tuesday morning when it just clearly wasn't the right call."

It all started when Seahawks quarterback Russell Wilson's last-gasp pass into the end zone appeared to be hauled down by Packers defensive back M.D. Jennings while Seahawks receiver Golden Tate also got his hands on the ball.

Two replacement officials made contrasting signals ? one indicated a touchdown, the other an interception ? and they eventually ruled on the field that Tate had simultaneous possession with Jennings, which counts as a reception by the offensive player.

Touchdown, Seattle. Game over, Packers.

The NFL acknowledged Tuesday that Tate should have been flagged for offensive pass interference earlier on the play, which would have ended the game with a Packers victory. But league officials said the referee was correct that no indisputable visual evidence existed on a replay review to overturn the touchdown call.

The result of the game, 14-12 Seattle, was final.

That's certainly not how the Packers saw it, insisting that Jennings clearly had intercepted the pass.

Quarterback Aaron Rodgers called it "awful" in his postgame interview and he didn't let up Tuesday. He called the league's conclusion "garbage" and said the officials were responsible for a "phantom" pass interference call earlier against the Packers before having "zero communication" after the final play.

"I've got to do something that the NFL is not going to do: I have to apologize to the fans," Rodgers said on his weekly radio show on ESPN 540-AM in Milwaukee. "Our sport is generated ? the multibillion-dollar machine ? is generated by people who pay good money to watch us play. And the product that's on the field is not being complemented by an appropriate set of officials.

"The games are getting out of control, and like I said in the first week, I said this, I'm OK with the replacement refs as long as they don't have a direct impact on the game," Rodgers said. "Obviously, last night, there was a direct impact on the game."

He added: "The game is being tarnished by an NFL who obviously cares more about saving some money than having the integrity of the game diminished."

Dallas Cowboys owner Jerry Jones told KRLD-FM in Dallas that he didn't catch the end of the game.

"I cut it off about halftime," he said. "I just read a little note in the paper that the Seahawks pulled it out."

Packers guard T.J. Lang posted a message on his Twitter account criticizing the call, then challenged the NFL to "Fine me and use the money to pay the regular refs." On Tuesday, Lang apologized for using profanity in his posts ? but said that was the only thing he regretted.

Fellow Packers offensive lineman Josh Sitton used his Twitter account to call on the NFL to come to Green Bay and apologize to the Packers.

"The NFL needs to get the refs back (before) we strike and they make no money!" Sitton posted after the game.

Rodgers, a players' union representative during the lockout, expressed skepticism about that happening and said, "Let's remember who we're dealing with."

"We're dealing with an NFL who locked out the players and said we're going to stand firm on our position," he said on the radio show. "... This is an NFL who gambled on some low-level referees, including the guy who makes the most important call last night, who's never had any professional experience."

After the so-called "Inaccurate Reception," a small Facebook group advocated an "Occupy Lambeau" protest movement before Sunday's game against New Orleans. Wisconsin Gov. Scott Walker used his Twitter account to call for the return of the regular officials ? a public show of support for locked-out unionized workers, an odd juxtaposition given his national reputation for going after public employee unions last year.

For all the bluster, few expect many empty seats or unwatched television sets on NFL Sundays.

"I mean, it's not the Packers' fault," Kroening said. "I pretty much live and die by watching them."

Mantuano, the other fan, said he was concerned that a team will miss the playoffs or a star player will get hurt because of a replacement official's mistake. He wondered aloud about the health of Rodgers, Tom Brady and Tony Romo.

Oddsmakers said millions of dollars changed hands on that now-famous play.

"Due to one call by the replacement refs, the bettors lost $150 million, and the bookie won $150 million for a total swing of $300 million on one debatably bad call," said RJ Bell of Las Vegas-based Pregame.com.

(AP) ? Israel ground almost to a halt Tuesday afternoon in preparation for Yom Kippur, Judaism's holiest day of the year.

The country has completely closed its airspace to airplanes, shut down its buses and trains, and locked its border crossings in preparation the holy day, which begins Tuesday evening and ends Wednesday after sundown. Restaurants, businesses and schools closed, government ministries shuttered, and Israeli television and radio stations went silent. Highways and roads emptied of cars ? a convention honored even by most secular and non-Jewish Israelis.

Yom Kippur is Judaism's day of atonement, when devout Jews ask God to forgive them for their transgressions. They refrain from eating and drinking and attend intense prayer services in synagogues. The day caps a traditional ten day period of soul-searching that began with the holiday of Rosh Hashanah, the start of the Jewish new year.

This year, the day of introspection comes amid heightened speculation that an attack on Iran's nuclear facilities could be near. When Yom Kippur comes to a close Wednesday night, Prime Minister Benjamin Netanyahu will make his way to New York to address the United Nations with one main message: Iran's nuclear program is an existential threat to Israel, and it must be stopped.

Israeli Chief Rabbi Shlomo Amar told Israel Radio that Israelis should pray this Yom Kippur that Israel's enemies be kept at bay.

"May God upturn whatever schemes they are scheming for us," Amar said.

Many Israelis also reflected on the 1973 Arab-Israel War, which Israelis call the Yom Kippur War because it broke out surprisingly on that day. The war marked a watershed moment in Israeli collective memory, when the country suffered heavy losses on the battlefield. On Tuesday, families published notices in the obituary section of newspapers in memory of their loved ones who died in the war.

Thousands of Jewish worshippers shrouded in white prayer shawls convened on the Western Wall Tuesday morning for last-minute penitent prayers. Some sounded long, curly rams' horns called shofars, traditionally sounded as a call to repent during the ten days of repentance.

Many of Israel's secular Jews fast for the day, but stay at home watching movies and playing board games. In another Israeli Yom Kippur tradition, secular children ride skateboards and bicycles through the empty streets.

At Jerusalem's outdoor market, many scurried around doing last-minute errands before the country shut down. Nearby, ultra-Orthodox Jews swung live chickens over their heads while reciting a blessing, then slaughtered the birds ? a symbolic ritual that transfers their sins to the animals. The practice has come under criticism in recent years, and many have replaced it by donating money to charity instead.

Adesu Masala, 72, an Ethiopian Jewish immigrant to Israel, was leaving the tailor's with a newly hemmed pair of dress pants to wear at his synagogue. He looked up to the heavens when he reflected on his prayers for the holy day.

"I will pray to God for a long life, and health for my children, wife and grandchildren," he said.

Tikva Horne, 70, was returning home from a visit to the doctor. She said she would be going to synagogue praying for "health for everyone, and that God forbid there will be a war."

Europe unveils banking union plan to tackle crisis

STRASBOURG, France (Reuters) - Europe moved a step closer to a banking union on Wednesday with a plan for the European Central Bank to supervise all euro zone banks, a cornerstone of closer fiscal integration designed to end years of financial turmoil in the region.

European Commission President Jose Manuel Barroso outlined the proposal in his annual "state of the union" address, laying out a path to further economic integration that he said he hoped would underpin the future of the euro currency.

The proposed banking reforms, which need to be approved by the European Union's member states, aim to break the link between banks and states, preventing heavily indebted countries being sucked further into difficulty by distressed lenders in need of rescue.

It tackles a core element of the crisis that first struck banks in Europe almost five years ago and escalated into a sovereign debt crisis in 2010.

"The crisis has shown that while banks became transnational, rules and oversight remained national," Barroso told members of the European Parliament. "We need to move to common supervisory decisions, namely within the Euro area."

"The single supervisory mechanism proposed today will create a reinforced architecture, with a core role for the European Central Bank," he said. "It will be a supervision for all Euro area banks."

For the plan to work, it will require countries to surrender a degree of sovereignty over supervising their banks. This has long been a national responsibility, and the proposal has already led to tensions with Germany and Britain.

Although Britain, which is outside the euro zone, will not join the scheme, many international banks in London have operations in the euro area that will be affected by the ECB's new supervisory reach.

London is also worried that the ECB, emboldened by its new powers, will demand regulation that could undermine the city's position as Europe's de facto financial capital. Similar concerns are shared by countries such as Sweden.

"We've said that a banking union for the euro area must also respect the integrity of the single market for the whole of the European Union," said a spokesman for the British Treasury. "We'll ensure the agreement on it does that."

Underscoring the sensitivity of this issue and its potential to upset the new banking framework, the European Commission has suggested the creation of a special voting mechanism among all EU regulators as a counterbalance to the power of those in the euro zone.

"We absolutely want to avoid the feeling that what we are doing means that the ins and the outs should be confronted with different interests or different agendas," said one EU official.

A banking union foresees three steps: the ECB getting the power to monitor all euro zone banks and others in the wider EU that agree to the oversight; the establishment of a fund to close troubled banks; and a fully fledged scheme to protect citizens' deposits across the euro zone.

Establishing a common framework for dealing with problem banks would mark a departure from the previously haphazard approach taken by the euro zone's 17 members that has frustrated investors and helped drive up borrowing costs for weaker states.

Handing powers of supervision to the ECB also unlocks the possibility of direct aid to banks from the euro zone's permanent rescue scheme, the European Stability Mechanism (ESM), although it is not clear when Spain and others would benefit.

The Spanish government, which has already been offered up to 100 billion euros ($128 billion) in European aid to rescue its most troubled lenders, welcomed the proposal on Wednesday.

APPREHENSION

Under the terms of the proposal, the ECB would be at the head of the currently fragmented system of national regulators, with the power to police, penalize and even close banks across the euro zone.

The ECB would also gain powers to monitor banks' liquidity closely and require them to keep more capital to protect themselves against future losses.

Reaching agreement on the terms of the union could be complicated, delaying the introduction of the new regime beyond the target set by euro zone leaders of the beginning of next year.

Germany, the euro zone's economic heavyweight, is opposed to allowing the ECB supervise all euro zone lenders.

Berlin says the central bank will be overstretched if it has to monitor all 6,000 euro zone banks. Commission officials argue that even small banks can cause a wider crisis, as happened with the bank run on Britain's Northern Rock in 2007.

The Commission's proposal foresees a phasing in of this supervision over a year and says the ECB should be able to police all banks. The ECB should begin monitoring half of the euro zone banking sector from the middle of next year.

Banks in Britain are also apprehensive about the impact of the new regime.

"The single market is Europe's biggest asset," said Anthony Browne, Chief Executive of the British Bankers' Association.

"Any splintering into a two-tier financial services market would threaten the ability of businesses across Europe to raise money for investment and would hamper economic recovery."
