Michael Douglas-Robert De Niro comedy 'Last Vegas' wins appeal of R-rating

LOS ANGELES (TheWrap.com) - BS Films on Thursday won its appeal of the R-rating initially given to the Michael Douglas-Robert De Niro comedy "Last Vegas," which will now be rated PG-13.

The Motion Picture Assn. of America's classification and rating appeals board announced the switch Thursday. The new rating for the film, which is to open on November 1, is for "brief sexual content."

Morgan Freeman, Kevin Kline and Mary Steenburgen co-star in "Last Vegas," which is directed by Jon Turteltaub ("National Treasure") from an original screenplay by Dan Fogelman. The plot follows four friends who throw a Las Vegas bachelor party for the only one who's remained single.

CBS Films in February shifted the release date from December 20 to November 1, positioning it as counter-programming to Summit's young adult sci-fi film "Ender's Game."

Family pitches in to save historic Oldham golf course

Mark Cumisky, 46, wants to add a cafe, driving range and putting green to the Bishop's Park and has already set his wife and three children to work.

A historic golf course has been saved after years in the rough ? and its new owners are? a family whose members are all set to pitch in.

Picturesque Bishop?s Park Pitch and Putt, set 1,233ft above sea level at Grains Bar, Oldham, had closed in October.

Council chiefs, sick of losing money on the Pennine foothills facility, opened it up to offers which sparked fears it may have been demolished.

But the nine-hole course is now to open again after being snapped up by an eagle-eyed Milnrow businessman.

Mark Cumisky, 46, wants to add a cafe, driving range and putting green to the site and has already set his wife and three children to work.

He beat off four other bidders to secure a 25-year lease and is now eyeing similar courses across the region.

Mark, who has worked on golf course construction and maintenance for 20 years, explained: ?I?ve been driving past it for 14 years and I thought it was a real shame the way it had been left to go downhill.

?I saw the lease sign and thought I?d make a go of it.?

Mark, who set up Pennine Golf Ltd with brother Carl, 51, wants to install a 280-yard driving range on a former cricket pitch next door and hopes to start work on it in the winter.

He reopened the 61-year-old course earlier this month and it has already become a family affair. He said: ?My wife, Colette, is going to run the cafe. My daughter, Kim, is working in the booking office while she?s home from university and my son Reece is working on the course with me while he?s off school. My youngest daughter Vicky is painting the tees.?

An agreement has also been reached with the nearby King?s Arms pub to host corporate outings.

Mark said: ?We?ve already had four or five companies interested.?

Coun Shoab Akhtar said: ?The facility was making year on year losses and as a council we decided to advertise it on the open market.

?This is great news for the borough and we?re delighted to grant this initial licence to the new tenant.?

Community theatre brings 'Sunshine' to GRCC | Entertainment ...

Heavier Than Air Family Theatre brings to life "Little Mary Sunshine", a musical that gently spoofs old-time favorites with lighthearted humor.

A flash will not be required when you have a bigger sensor, as ther will be plenty of light falling even when at low light conditions... A Xenon Flash or any other flash it may be will make the picture look flat... there will be no difference between the object and the background and both will lie on the same line (No 3D effect)... That is why top end DSLR's do not come with a flash attached, since most photographers will not use them with a full frame sensor or they will use light reflectors...

The newly legalized couple cheered the ceremony as a marriage, although experts cautioned that a high court ruling that deemed the Union legal did not make it the equivalent of marriage. "We are civilly married," Gonzalo Ruiz, 44, told The Associated Press just after ceremony with his partner, Carlos Hernando Rivera, 57. The ceremony follows Congress' failure in April to pass a law setting up a legal framework for civil unions. A 2011 order from the Constitutional Court had ordered legislators to pass a law granting marriage equality to gay couples by June 20, 2013, or else such couple would be allowed to join in civil unions before judges. A previous ruling by the high court had allowed same-sex couples in Colombia to enjoy since 2007 many of the benefits of marriage, including inheritance, pensions and health and death benefits. "They entered as bachelors and exited married," Marcela Sanchez, director of Colombia Diversa, an LGBT-rights group, said after about 100 guests celebrated the Union by throwing rice at the couple. Good Cop, Bad Cop: Comparing the Law of Police Interrogations in Canada and Japan

One interesting scrap of legal news that passed under the radar recently was a testy exchange involving Hideaki Ueda, Japan?s human rights envoy to the United Nations at a session of the UN torture committee in Geneva, Switzerland. The donnybrook arose when a fellow envoy called-out the Japanese criminal system for not mandating electronic recording or the presence of counsel at police interrogations. Mr. Ueda sprang to his nation?s defence, only to be met by the audience?s muffled laughter. In true diplomatic fashion, Japan?s emissary responded by telling his esteemed colleagues to ?shut up? not once, but twice.

At first glance, Japanese procedure regarding the recording of police interrogations shouldn?t be that shocking to Canadian lawyers. Like our Japanese friends, Canada doesn?t require that interviews be videotaped or that defence counsel be present.[1] That said, the Japanese context is somewhat different in that the police over there seem a little more fixated on scoring confessions than adhering to any pesky constitutional limits.

That the Japanese authorities refer to an accused?s confession as ?the King of Evidence? should give you some insight into how they roll. Japanese police have been in the spotlight over the past decade for reaching an altogether new standard in ?robust? interview methods that reportedly include physical abuse, sleep deprivation, threats, isolation and marathon sessions.[2] In fact, Amnesty International cites the Japanese justice system?s propensity for ?torture and ill-treatment? to procure confessions as an ongoing concern. In one 2007 case, a court in Saga prefecture acquitted a man who confessed to three murders following seventeen days of ten hour-plus grilling by the local constabulary. More recently, a hacker was apprehended and subsequently convicted of making threats over the internet, but not before police had managed to extract four separate confessions from four different individuals for the exact same crime. In an interesting twist, the real perpetrator cited their reason for making the threats as a way ?to expose the police and prosecutors? abomination.?

Comparatively speaking, Canada appears to be a veritable nanny state. In this country, the rule relating to the evidentiary admissibility of confessions is rooted in centuries of common law, and holds that any confession made by an accused to an authority figure outside the courtroom is inadmissible unless the prosecution can illustrate beyond a reasonable doubt that the confession was made voluntarily. This was reaffirmed most recently by the Supreme Court of Canada in R. v. Oickle, which revisited the rule precisely because of growing judicial cognizance of aggressive interrogations and the false confessions they can engender.[3]

Japanese authorities however appear quite blas? about the whole phenomenon. In fact, they?re aided in their Bronson-esque investigative methods by a legal system that essentially puts suspects at their mercy. A suspect can be held for up to three days by police and prosecutors before he or she sees the inside of a court room. Moreover, police and prosecutors frequently work together to avail themselves of the daiyo kangoku, or ?substitute prison? procedure which permits a suspect to be detained for a further 23 days without charge. This extended period of incarceration must be approved and then renewed every 10 days by a judge ? something that happens 99.77% of the time according to official government statistics.[4] Contrast this with Canada?s ?soft on crime? approach which mandates that according to Section 503(1)(a) of the Canadian Criminal Code, an accused must be brought before a Justice of the Peace within 24 hours to determine if they will be released or remanded into custody.

The Japanese are also not too hot about having suspects talk to their lawyers. While Articles 34 and 37(2) of the Japanese Constitution purportedly enshrine the accused?s right to counsel, Article 39 of the Japanese Code of Criminal Procedure eviscerates this principle by permitting authorities to control the timing and duration of these consultations if it would ?interfere with the ongoing investigation?.[5] In contrast, the Supreme Court of Canada has been a little more protective of an accused's rights. In R. v. Suberu, the Court interpreted Section 10(b) of the Canadian Charter of Rights and Freedoms: ?everyone has the right upon detention to retain and instruct counsel without delay and to be informed of that right?, to mean that a detained suspect is entitled to speak to a lawyer ?immediately? upon their detention and that the police have a duty to facilitate the process.[6]

So, how do these two legal systems stack-up? The stats are telling ? while the Japanese might be loose cannons, dammit, they get results. With a commendably efficient conviction rate of 99.7%, Japanese police and prosecutors make their Canadian brethren look like black sheep living in their parents? basement ? the latter checking-in with a paltry 64% success-rate as of 2011.

Given that Japan strove to fashion itself as a western-style liberal democracy in the decades following World War Two, the authorities? prevailing tactics and attitudes are particularly perplexing. For example, Chapter Three of the Japanese Constitution offers broad protections to the criminally accused that bear striking resemblance to those enshrined in the U.S. constitution, and so would be recognizable to any Canadian who has watched an episode of Law and Order. The similarity is unsurprising: the Japanese document was drafted with heavy American involvement following Tokyo?s defeat in World War Two. Specifically, Articles 36 and 38 of the Japanese Constitution explicitly prohibit the use of torture by police as well as self-incrimination and compelled confessions.[7]

So how did the islands that gave us Hello Kitty and astonishingly jovial Blue Jays? shortstop Munenori Kawasaki also manage to create a criminal justice system that?s presumptively modeled on an episode of The Shield? The answer has something to do with the difference between legal codification and legal culture. In 1890 Japan introduced a constitution that provided for the rule of law through representative government, separation of powers and the protection of civil liberties. One important, nagging carve-out however, was that the Emperor retained absolute power over the country. While the Emperor is only a figurehead these days, police and prosecutors have since done their best to take up his mantle as ?heavenly sovereign? when it comes to assigning guilt. The result is that Japan?s Thin Blue Line apparently sees its Constitution not so much as a set of codified, unalienable rights, as an inconvenient guideline that hinders them from putting no-good punks behind bars.[8]

In fact, some of the policy rationales used to justify business-as-usual in Japan would strike Canadian observers as bizarre inversions of how a justice system should work. While Japan?s law talks about a presumption of innocence, observers have noted a de facto onus on defendants to prove their innocence at trial. [9] Moreover, there is no requirement that authorities reveal exculpatory evidence, increasing the risk of false convictions. [10] When the debate over recording of police interrogations erupted in the early 2000s, police justified their opposition on the grounds that suspects would be less likely to confess. Too true.

And historically-speaking, Japanese society hasn?t seemed to mind the state?s general aversion to protecting their constitutional rights. The theories explaining this cognitive dissonance are broad and varied, ranging from Japan?s history as a civil law system, to its cultural tendency towards deference to authority, to its general attitudes towards crime and punishment, to straight-up bureaucratic and judicial inertia.[11]

But, before we Canadians get too smug about the splendour of our own criminal justice regime, it should be noted that Canadian police aren?t exactly paragons of virtue when it comes to making suspects talk. Cops in Canada have repeatedly been taken to task by judges for their aggressive use of interview methods such as the ?Reid technique?, which have been found in some cases to produce false confessions. In the Reid scenario, an interviewing officer will subject the accused to lengthy questioning, repeated interruptions and constant assertions of guilt in the hope of garnering an admission of guilt. In R. v. Chapple, an Alberta court was scathing in its appraisal of the Calgary police service?s methods when it ruled that a defendant?s confession was inadmissible as evidence on the grounds that the Reid technique had been employed in an oppressive way:

I denounce the use of this technique in the strongest terms possible and find that its use can lead to overwhelmingly oppressive situations that can render false confessions and cause innocent people to be wrongfully imprisoned. In this case, the police were convinced of the accused's guilt even though there was medical evidence available that was consistent with the accused's version of events. They pushed ahead with the interview with one goal in mind: a confession.

Moreover, before one criticizes the underlying assumptions and mores of Japanese legal philosophy, it also bears mentioning that Japan is home to far lower per capita incarceration and recidivism rates than most developed nations. The moral of the story is that while helpful, recording interrogations is by no means a cure-all for police excess. Instead, what?s required is broad, societal commitment to the presumption of innocence and a transparent justice system ? and it?s here where Japan has traditionally been M.I.A.

All of which brings us back to the travails of the hapless Mr. Ueda. While the use of video recording has expanded in police and prosecutorial interrogations over the past decade, practical problems remain evident. Electronic documenting of police interrogations in Japan began in 2006, and this year it was proudly proclaimed that 97% of interviews relating to ?major? crimes were taped. In absolute numbers however, this amounted to a mere 67 cases in a nation of approximately 130 million people. Prosecutors have also jumped on the VHS bandwagon, though a majority of prosecutorial examinations still aren?t taped. As of June 2013, recordings are only mandated for certain serious offences, and even then, police and prosecutors have the final say on what portions of their interviews actually get recorded.

But times in Japan may well be a-changin?. The Japanese Federation of Bar Associations has been outspoken in its efforts to reform the law, and there is increasing public outcry over highly-publicized examples of police and prosecutorial misconduct. [12] The authorities appear to be listening. In 2009 Japan instituted the jury-style ?Saibanin? system for serious crimes in an effort to make legal proceedings more transparent.[13] This shift marked the first time in the postwar era that Japanese citizens had a participatory role in court proceedings. [14] More recently, the widespread shock expressed in the Japanese media following Mr. Ueda?s outburst in Geneva suggests that popular attitudes towards suspects? rights may be evolving. With this development comes the realization that the sun might indeed be setting on a truly badass era in the history of Japanese policing.

Despite the differences between the laws of our two great nations, Japanese cops have clearly taken at least one cue from the Canadian experience. Foremost, they appear to have directly cribbed the Mounties? old adage ?we always get our man? though, in true Japanese style, they?ve adapted it to suit their own sensibilities: while the RCMP sees the motto as more of a loose aspirational goal, Japanese cops mean it. I mean, they really mean it.

The spokesperson added, "People don't like to be sold on especially on social media, which is a place for the sharing the interesting information. Our primary focus is on providing lots of good contents as well as a few occasional promotions."

(AP) ? Even though Pope Francis' motorcade ended up stalled on a traffic-choked street and swarmed by thousands of faithful, Brazilian officials said Tuesday they evaluated security for the pontiff's arrival in Rio as "positive."

The frenzied crowd surrounded the motorcade Monday afternoon as people reached inside to touch Francis, snap photos with their phones or hand him babies to kiss ? scenes that alarmed some onlookers, although the pope himself seemed overjoyed with the raucous welcome and kept his car window down. Francis later moved through the masses in an open-air vehicle.

Early Tuesday, Brazilian security forces blamed each other for the lapse, and no one took responsibility for the traffic fiasco, which began when the driver of the pope's car made a wrong turn.

Later though, federal police, who are in charge of most of Francis' security, took an upbeat tone.

The agency said a meeting was held with officials from a federal agency overseeing megaevents that Brazil is hosting over the next few years, the highway police who played a role in the motorcade's planning and the Rio mayor's office to evaluate the security provided.

"The evaluation was positive, since there was no incident involving the pope or with any of the faithful," an emailed note read.

It added that the swarming and halting of the motorcade "occurred for a number of reasons, in particular the options of the Vatican itself, concerning the visibility and contact with the pilgrims, expressed by the pope himself. The reduced speed of the motorcade and the vehicle's open window are facts revealing the profile of this pontiff and the encouragement given to the faithful to approach."

Federal police didn't respond to requests for more explanations on how the breakdown in security happened.

Cardinal Timothy Dolan, archbishop of New York and president of the U.S. Conference of Catholic Bishops, is in Brazil and said that in watching the motorcade scene, "I was one of those alarmed myself." He said he was concerned about the pontiff's security.

"I love him and I don't want another conclave. We just finished one so we don't need him to be hurt at all," Dolan said. "So they might need to up the security a bit. But the people of Brazil, the people of Latin America, tend to be enthusiastic by nature, they're just so dynamic in their faith."

Experts said that allowing the pope's car to be swarmed was a grave mistake, but they agreed that the desires of Francis to be out among the public made it difficult to ensure his security.

Paulo Storani, a Rio-based security consultant who spent nearly 30 years on the city's police force and was a captain in an elite unit used to clear out slums, said the events seen Monday had to be analyzed in two ways.

"From the point of view of a head of state, and the pope is a head of state, it's unacceptable what happened. The proximity people had with him was a huge risk, even for his image," Storani said. "On the other hand, in the case of a head of a church and having a charismatic figure like this pope, the situation is different because he wants to be close to the people."

"The police intelligence units have to do a lot more work to detect potential threats to the pope's security and there needs to be a bigger presence of plainclothes officers in the middle of the masses to ensure his security," Storani added.

Ignacio Cano, a researcher at the Violence Analysis Center at Rio de Janeiro State University, said that despite the problems with the motorcade, it's the style and message that Francis wants to get across that is the source of woes for officials.

"It is a difficult situation because authorities want the pope to surround himself with protection, something that goes against the message he wants to impart which is one of simplicity, openness and approximation," Cano said. "In light of this message, isolating him from contact with the people makes no sense at all."

Authorities in Brazil had said about 10,000 police officers and more than 14,000 soldiers would take part in the overall papal security plan, but on Monday virtually no uniformed officers were seen along the motorcade route.

There were few barricades set up along the route and thousands of faithful easily made their way onto streets that were meant to be sealed off from the public. In some places along the route, people could be seen forming "human chains" to keep the crowds at bay.

For a nation that will host the 2014 World Cup and a city that will host the 2016 Olympics, it was a blow for the globe to see television images of the pontiff's car being mobbed and stuck in traffic. The scene comes a month after violent, nationwide protests broke out during the high-profile Confederations Cup soccer tournament, when the nation was also in the global spotlight, unrest that continued Monday outside the government palace where Francis met with top Brazilian leaders.

The papal spokesman, the Rev. Federico Lombardi, made clear that despite the mobs, Francis wouldn't change his decision to use an open-air vehicle and specifically planned to use the open car for the very events expected to draw the largest crowds: a speech on Copacabana beach Thursday, a Way of the Cross procession Friday, and a weekend vigil and Mass in a rural part of Rio.

Lombardi said the pontiff deliberately chose to use the same car he uses in St. Peter's Square, and not the bulletproof popemobile, to be closer to people and interact with them. But that square is a closed and controlled, with Vatican and Italian police ringing the square, the faithful being fenced into pens, and bodyguards trailing the car at all times.

Yet how Vatican and Brazilian authorities decide to organize his security going forward is ultimately not the pope's responsibility, Lombardi said.

"Obviously he desires to have a possibly very direct contact with the people. This is clear, and not a militarization of the situation," said the spokesman. "But the concrete solutions are not chosen by him."

On Wednesday, Francis travels to the town of Aparecida in Sao Paulo state, where the governor said 1,800 police will provide security for the pope.

He's traveling to the town to venerate the Virgin of Aparecida, Brazil's patron saint. About 200,000 faithful are expected to pack into the normally sleepy hamlet where Francis is scheduled to drive about a half mile (1 kilometer) in an open-air vehicle after he lands.

Francis is visiting his home continent for the first time since becoming pontiff, with his visit coinciding with the church's World Youth Day, an event held every three years to bring young Catholics together in an effort to inject new energy in the church.

Study: Parents are funding less of their kids' college tuition

(CBS News) LOS ANGELES -- Nobody but bankers was happy when interest rates on college loans doubled to 6.8 percent this month. But Wednesday, the Senate may vote on a plan to roll them back. College costs have been soaring, and a study out Tuesday shows that parents are not picking much of the tab as they used to. In 2010, they funded 36 percent; now it's more like 27 percent.

Asked how much of a factor was cost in searching for colleges, Phan replied: "It was the biggest factor, actually. I was actually going to apply to a bunch of private schools, but I didn't apply to any because my mom could not afford them anymore."

The survey released Tuesday showed 67 percent of students eliminated schools during their college search because of cost -- up from 58 percent in 2008. Parents used to pay the biggest share of their children's tuition bill. Now grants and scholarships cover 30 percent of college costs, while parents fund 27 percent. Loans cover 18 percent.

It's not that parents are suddenly cheap -- it's that college tuition has outpaced inflation by 27 percent in the past five years. Tuition and room and board at a private four-year college averages just under $40,000.

"Each year it goes higher and higher," said Phan, "and it's hard because I know my family income isn't increasing at the same rate that college tuition is increasing. I was very careful to make sure that I didn't ask my parents for too much."

Phan plans to live with an aunt close to campus, saving $10,000 in room and board.

"If I didn't have the scholarships or grants," she said, "I would definitely be struggling with debt until I was 40. It's just too much."

While her first year is all but paid for, she has to keep her grades so she can keep her grant.

Ah, if only every church would turn in lawbreakers in their midst.

It would appear one mosque did just that. One of it's members talked to others of committing acts of violence, ultimately he was turned in.

Not moved around. Not glossed over. Not ignored. But turned in.

Kudos to them for doing the right thing as opposed to ignoring a problem. I certainly hope this would serve as an inspiration to all religions that this sort of nonsense, the in house forgiveness, is the wrong route, and I certainly hope this would send a bit of notice to those who single out Islam as being inherently violent that there are plenty of decent, law abiding folks within Islam.

A 19-year-old accused of traveling to the Middle East to train with terrorists raised the suspicions of people at a Florida mosque when he started talking to other teens about violence.

Parvez Ahmed, the board secretary at the Islamic Center in Jacksonville, said Friday that Shelton Bell talked to other kids about jihad and the civil war in Syria. The other kids' parents became concerned.

Ahmed says mosque leaders consulted their attorney and then notified law enforcement because they were concerned about Bell's statements.

A federal grand jury indicted Bell, on charges of conspiring and attempting to provide material support to terrorists. He is being held at the county jail in Jacksonville on unrelated state charges.

Trio arrested in front of church; 'True Religion' heroin found

Police arrested three people in front of Sacred Heart Church Thursday after allegedly finding 350 bags of "True Religion" heroin in the trunk of their car.

Rafael Cruz, 34, of undetermined address; Alfred Smart, 28, of 81 Elmwood Ave., Bridgeport. and Ariane Rey, 34, of 4 Crescent St., Ansonia, were arrested shortly after an 8:45 p.m. traffic stop led to a search of their car on suspicion of drugs, Police Sgt. Chris Broem said. All face multiple multiple charges involving narcotics and conspiracy. Cruz and Smart are also charged with sale of narcotics.

The heroin has a street value of $7,000, police said. It was wrapped as though it had just been picked up that night, Broem said; Cruz told officers the three had been in the Bronx, N.Y., earlier that day. Broem said he is concerned about the presence of heroin in Stamford.

"They were on the streets of Stamford, that's not good," he said.

Broem, who came to the scene in support of Lt. Christopher Baker, who made the stop, said Smart, the driver, was stopped for a traffic violation.

Police then determined the Ford Focus he was driving had no insurance. Smart also had difficulty answering questions, Broem said and Cruz was nervous.

Five units had been sent out Thursday night to find and stop drivers under the influence of drugs and alcohol, Broem said.

A police dog brought to the scene indicated there were drugs in the vehicle, he said. When officers popped open the trunk, they found 350 bags of heroin labeled "True Religion," Broem said. He said that label is usually reserved for high-quality heroin.

Smart and Cruz both were each held on $75,000 bond. Rey was released on a written promise to appear in court.

Google Play Music All Access extends to New Zealand and Australia

When Google Music received the huge improvement of All Access unlimited streaming of music to take on Pandora and Spotify, many were sad to hear it was only for the US. Google?s just pushed Music All Access and Google Play Books to multiple new regions and countries and figured a quick shout out was in order.

Google Play Music All Access is the biggest news here, as it?s no longer a US exclusive. While big markets are still waiting for it, as I?m sure Google?s hard at work dealing with record labels, All Access can now be enjoyed in New Zealand and Australia. Down under can enjoy some classic tunes Google style.

According to a Google Support Page we can expect more regions in the future, but sadly have nothing to announce. Google Music is my new go-to music option, and I?ve since uninstalled Rdio and Spotify so the few new areas should be happy to give it a try. Too bad the discounted trial ended in June, and now you?ll be charged $9.99 per month for unlimited music.

Then according to Google multiple countries should now be seeing Google Play Books in their market on devices and the web. According to what we?re hearing Books are now in places like Romania, the Netherlands, Czech Republic, Denmark, Greece and even Hungary. Oh and we almost forgot Poland and Finland both have access now too. Hopefully Google Music reaches more locations soon, and we?ll report once we learn anything else.

Rave universe shows galactic imprint of quasar light

Is this a satellite shot of a country at night, lit up by glittering cities? Or perhaps a collection of raving microbes, pulsing to a neon rhythm? Nope, it's a 600-billion-billion-kilometre-wide chunk of the universe ? or at least a simulation of it.

Astronomers working on the Baryon Oscillation Spectroscopic Survey (BOSS) are attempting to map galaxies and hydrogen gas clouds in the universe by looking for the light of super-bright quasars, luminous objects that are thought to be powered by black holes devouring matter. Galaxies and gas clouds leave an imprint on this quasar light as it passes through them, which can be used to deduce their positions.

To make sense of these imprints, the BOSS team create simulations of quasar light passing though cosmos-spanning gas clouds and compare them with the real thing. The picture above shows a simulation of a cube of the universe 65 million light years across. The red blobs are clusters of galaxies, while the blue filaments show regions of low-density filled with clouds of gas.
